A man has suffered critically injured after he was struck by a transit bus at a Fontana intersection. According to a KTLA news report, the crash occurred at the intersection of Sierra and Upland avenues the afternoon of May 7. Police say the Omnitrans bus was southbound on Sierra Avenue when it struck the man. Officials said the man was “in between crosswalks” at the time. He was transported to an area hospital in critical condition. A passenger on the bus was also transported after complaining of suffering minor injuries when the bus came to an abrupt stop.
Omnitrans told police that the bus driver involved in this collision had worked for them about five years. The driver will be subjected to drug testing, as required by Omnitrans’s guidelines. The bus was equipped with a surveillance camera and police will look at the footage as part of the investigation, which is still ongoing. No one has been arrested or cited.
Our thoughts and prayers are with the severely injured victim of this bus versus pedestrian crash. We wish this victim the very best for a speedy and complete recovery.
According to California Highway Patrol’s 2014 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 39 injuries involving pedestrian accidents in the city of Fontana. In San Bernardino County as a whole, 67 people died and 473 were injured due to pedestrian accidents during the same year.
Fault and Liability
Based on this news report, it appears unclear whether the pedestrian was in a crosswalk or if he was walking outside a marked crosswalk. Police say it seems the pedestrian was “in between crosswalks.” Regardless of where pedestrians are walking in marked or unmarked crosswalks, the law requires drivers to exercise due care by stopping or slowing before proceeding through intersections.
In this particular case, if the bus driver is determined to have been negligent, the victim may be able to seek compensation from the transit authority. Injured victims in such cases can seek compensation for damages including medical expenses, lost wages, hospitalization, cost of rehabilitation, pain and suffering and emotional distress. An experienced San Bernardino personal injury lawyer will be able to advise injured victims and their families regarding their legal rights and options.
