Laws and Liability Issues
The news report states that while the driver had a stop sign, the motorcycle officer didn’t. This car versus motorcycle accident is very typical of street intersection accidents where drivers of larger vehicles fail to spot smaller vehicles such as motorcycles or bicycles. A majority of motorcycle accidents do happen at street intersections because drivers are not consciously looking out for motorcyclists, especially when they make turns. California Vehicle Code Section 21802 (a) also requires drivers to come to a complete stop at a stop sign and proceed with caution.
If the driver in this case is determined to have been at fault, then he and his employer, the Internal Revenue Service, could be held liable for the serious injuries caused to the motorcycle officer. Victims in such cases would be well-advised to retain the services of an experienced Santa Ana car accident lawyer who will stay on top of the official investigation and ensure that their legal rights and best interests are protected.
