Jose Rubio, 51, sustained critical injuries in a Riverside car accident after two vehicles collided at a street intersection in Coachella. According to a news report in The Press-Enterprise, the major injury crash occurred the morning of April 26, 2010 at the intersection of Avenue 50 and Van Buren Street in Coachella. Julio Hernandez, 42, sustained minor injuries. Police say that a 2008 Nissan Sentra being driven by Hernandez and Rubio’s 1971 Ford Ranger pickup truck entered the intersection at the same time. Officials say one of the drivers failed to stop for a red light. Police are looking into which one of the drivers ran a red light.
My heart goes out to both injured victims especially Rubio who sustained critical injuries. I wish both injured victims the very best for a speedy and complete recovery from their injuries.
Car Accident Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were seven fatalities and 68 injuries involving car accidents in Coachella. In Riverside County as a whole, car accidents claimed 220 lives and injured 8,561 people during the same year.
Red Light Running
If the details of this news report are accurate, it appears that one of the drivers ran a red light and struck the other vehicle. There are various California Vehicle Code sections that are part of what we commonly refer to as “rules of the road.” These code sections address motorists’ behavior at intersections, especially those controlled by traffic signals.
California Vehicle Code Section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”
Claim for Compensation
If Hernandez is determined to have run the red light in this injury crash, he could be held financially responsible for Rubio’s serious injuries. If Rubio committed the violation, then he could be held liable for Hernandez’s injuries and damages. In these types of accidents, injured victims could seek compensation to cover medical expenses, cost of hospitalization, surgeries, medication, loss of earnings, pain and suffering, and other related damages.
