San Bernardino Car Accident Proves Fatal

By

Gary Talbott, 68, was killed in a San Bernardino car accident, which officials say, involved a head-on collision. According to a news report in The Victorville Daily Press, the fatal car accident occurred on Hesperia Road in Victorville the morning of January 10, 2011. Talbott was killed when two vehicles crashed into each other north of Seneca Road. The condition of the other driver is not known at this time. It is unclear why one of the vehicles veered into oncoming traffic.

My deepest condolences go out to the family and friends of Gary Talbott following this tragic car accident. My thoughts and prayers are also with the other driver who had to be extricated from the vehicle.

Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 16 people were killed and 266 were injured in Victorville car accidents. During the same year, there were 263 fatalities and 8,504 injuries reported due to San Bernardino County car accidents.

What Caused This Fatal Head-On Accident?

Based on this news report, it is not clear which driver was at fault here. According to California Vehicle Code Section 21651 (a): “Whenever a highway has been divided into two or more roadways by means of intermittent barriers or by means of a dividing section of not less than two feet in width, either unpaved or delineated by curbs, double-parallel lines, or other markings on the roadway, it is unlawful…to drive any vehicle over, upon, or across the dividing section.”

Liability Issues

In this case if the other driver is determined to have been at fault, he or she could be held civilly liable for Talbott’s wrongful death. I trust officials are also looking into whether intoxication, distracted driving, speeding or any other form of negligence led to this tragic car accident. If Talbott is determined to have been at fault, the other injured party can claim compensation from Talbott’s estate and liability insurance.
