San Bernardino County Fatal Motorcycle Accident

Edgar Hernandez-Uribe, 18, died in a fatal San Bernardino motorcycle accident the morning of July 1, 2009 on the 10 Freeway in Colton. According to the San Bernardino Sun, Edgar Hernandez-Uribe was riding a 2007 Yamaha motorcycle when he veered off the freeway and crash. The impact threw him off the bike, California Highway Patrol officials said. Hernandez-Uribe was pronounced dead at the scene.

I offer my deepest sympathies to the family and friends of young Edgar Hernandez-Uribe for their tragic and heartbreaking loss. My heart goes out to everyone who knew and loved this man. Please keep them in your prayers.

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there was one fatality and 23 injuries involving motorcycle accidents in Colton. In San Bernardino County as a whole, 28 deaths and 627 injuries were reported as a result of motorcycle accidents.

Based on this news report, there is not much information about how or why this fatal motorcycle crash may have occurred. There is no indication in the report, however, that Hernandez-Uribe was speeding or riding his bike in an unsafe manner. So, naturally, a number of questions arise relating to the cause of this accident. Was there an unsafe or dangerous condition on the roadway that caused Hernandez-Uribe to lose control of the motorcycle? Was there was another vehicle involved, whose reckless or negligent driving caused Hernandez-Uribe to go off the freeway. It is also possible that there was a mechanical malfunction or a motorcycle product defect, which caused him to crash.

Yamaha motorcycles have been the subject of many product safety recalls in the last two years. The defects range from fuel pump leaks and defective throttle to engine stall risks that could result in a crash. If I were a member of Hernandez-Uribe’s family, I would preserve the motorcycle in its current crashed condition, unaltered, so it can be examined by an expert for evidence of mechanical malfunction or auto product defects.

Hernandez-Uribe’s family would be well-advised to retain the services of a reputed San Bernardino motorcycle accident lawyer who will examine and analyze all aspects of this fatal motorcycle crash and advice the victim’s family about how to pursue their legal rights. In cases where negligence or wrongdoing is involved, families of deceased accident victims may file a wrongful death claim seeking compensation to cover medical or funeral expenses, lost wages, loss of companionship and other related damages.
