San Bernardino DUI Car Accident Causes Critical Injuries

Charlotte Anderson, 64 and Stephen Anderson, 63, were seriously injured in a San Bernardino car accident after the car they were in was rear-ended by a speeding driver who is also suspected to have been driving under the influence. According to a news report in the Hi Desert Star, 28-year-old Jennifer Belle was driving a 2006 Nissan Armada at speeds of about 85 mph the evening of February 19, 2010 on a Joshua Tree roadway.

She was unable to control her SUV and collided into the back of a Chevy Lumina driven by Charlotte Anderson. Charlotte Anderson sustained critical injuries while her passenger, Stephen Anderson, was in serious condition. Belle was not seriously injured and was arrested on suspicion of drunk driving.

Victims of a DUI Collision

I sympathize with the Anderson family for what they are going through right now as a result of this DUI collision. I hope and pray Charlotte Anderson makes it through her life-threatening injuries and is able to make a complete recovery. I also wish Stephen Anderson the very best for a speedy and full recovery.

Violations of the Law

I hope Belle, if found guilty, gets the punishment she deserves. Not only is she accused of speeding, but also of driving under the influence, both of which are serious violations of California law. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

Also, California Vehicle Code Section 22350 (Basic Speed Law) states: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

Claim for Compensation

The victims of this horrific crash and their families would be well-advised to retain the services of an experienced San Bernardino car accident lawyer, who will keep abreast of this investigation and make sure that the victims’ legal rights and best interests are protected. Victims in such cases can seek compensation to cover medical expenses, lost earnings, cost of hospitalization, surgeries, rehabilitation, physical therapy and even long-term care. A knowledgeable car accident lawyer will also be able to advise families about how their car insurance policy applies to an incident involving an uninsured or underinsured driver.
