A 6-year-old girl and her aunt were injured in a San Diego car accident after they were struck by a vehicle while walking in a marked crosswalk. According to a 10News report, the injury car accident occurred at the intersection of Menlo and University avenues, the morning of October 10, 2011. A woman driving a grey Honda Accord hit the girl and her aunt. The girl was rushed to a local hospital with head injuries. The aunt sustained relatively minor injuries. The driver told police she was driving east on University Avenue when she was blinded by the sun and did not see the woman and girl in the crosswalk. It is not clear if the motorist will be cited.
My heart goes out to the pedestrians, especially the young girl who has been seriously injured. I wish both the victims the very best for a speedy and complete recovery. Please keep them in your thoughts and prayers.
San Diego Pedestrian Accidents
According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), there were 18 fatalities and 494 injuries involving pedestrian accidents in San Diego. Also, countywide, 57 people died and 937 were injured due to pedestrian accidents, during the same year.
Based on this news report, the pedestrians were walking in a crosswalk when the vehicle struck them. Motorists are required by California law to yield the right-of-way to pedestrians in marked or unmarked crosswalks.
California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”
Claim for Compensation
If the driver of the Honda is determined to have been at fault here, she could be held liable for the resulting injuries, damages and losses. In such cases, injured victims can seek compensation for medical expenses, loss of earnings, cost of hospitalization, rehabilitation, and other related damages. Car accident victims or their families would be well-advised to contact an experienced San Diego personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable.
