San Francisco Car Accident Injures Motorcyclist

A 42-year-old man was injured in a San Francisco car accident when a vehicle backed into his motorcycle. According to a news report in The San Francisco Examiner, the injury motorcycle accident occurred in the Sunset neighborhood near 20th Avenue and Taraval Street the morning of December 27, 2010. The man was riding his motorcycle when a white Hyundai backed out of a parking lot and struck him. The Fremont man sustained non-life-threatening injuries. An investigation is ongoing.

My thoughts and prayers are with the man injured in this San Francisco motorcycle accident. I wish him a complete and speedy recovery from his injuries.

San Francisco Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), eight people were killed and 349 were injured in San Francisco motorcycle accidents. Also, citywide, 35 fatalities and 3,577 injuries were reported due to car accidents during the same year.

What Caused This Motorcycle Accident?

If this news report is accurate, it appears that the driver of the Hyundai backed into traffic without properly yielding the right-of-way to the motorcyclist. According to California Vehicle Code Section 21804 (a): “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic.” Vehicles entering traffic “shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.” I trust officials are also looking into whether the driver of the Hyundai was impaired, distracted or negligent in some other way at the time of this injury accident.

Liability Issues

Victims of negligent drivers may file a personal injury claim seeking compensation for their injuries, damages and losses. Injured car accident victims can seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. If the driver is determined to have been at fault, he or she could be held financially liable. If there was a dangerous condition on the property, which caused or contributed to this accident, the property owner could also be held liable. An experienced San Francisco personal injury lawyer will be able to better advise injured victims in such cases about their legal rights and options.
