School Bus Accident in Gardena Involves Suspected Drunk Driver

Five children were injured in a Los Angeles car accident after a vehicle collided with their school bus. According to a KTLA news report, the bus accident occurred at the intersection of South Main Street and 157th Street in Gardena, the afternoon of June 14, 2012. Officials say a Mitsubishi Eclipse was making a right onto 157th Street when it collided with the school bus sending the bus crashing into the wall of a building on South Main Street. Police say that female driver of the Eclipse had alcohol on her breath and appeared to be intoxicated. She is expected to be booked on suspicion of driving under the influence. None of the injuries is believed to be life threatening.

My thoughts and prayers are with the injured children. I wish them the very best for a speedy and complete recovery. It is indeed fortunate that none of them suffered critical injuries.

DUI Statistics

There were no fatalities, but 24 injuries involving alcohol-related crashes in Gardena during the year 2009, according to the most recent statistics made available by the California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS). In Los Angeles County as a whole, 204 people died and 4,672 were injured as a result of DUI collisions, during the same year.

Laws and Liability Issues

Based on this news account, it appears that the female driver of the Mitsubishi was under the influence of alcohol when she made a right turn and collided with the school bus. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” Under the same section, it is illegal for motorists to operate a motor vehicle with blood alcohol concentrations of 0.08 percent or higher.

In such cases, injured victims or their families can seek compensation from the at-fault or negligent motorist for damages such as medical expenses, lost wages, cost of hospitalization, rehabilitation and other related damages. Car accident victims would be well advised to contact an experienced Los Angeles car accident lawyer who has a successful track record of financially pursuing drunk drivers.
