A 14-year-old boy suffered critical injuries in a pedestrian accident near San Juan Hills High School in San Juan Capistrano the morning of November 28, 2017. According to a news report in The Orange County Register, the major injury collision took place at Via Pamplona and Stallion Ridge, which marks the entrance to a residential development, which is often used as a turnaround by motorists. The driver remained at the scene. No arrests or citations have been issued. The investigation is ongoing.
Our thoughts and prayers are with this critically injured teen who was hit on his way to school. We wish him the very best for a speedy and complete recovery.
Was This a Dangerous Intersection?
Based on this news report, it appears that this pedestrian accident occurred at an intersection that residents have been calling out as dangerous for quite some time. One resident says people are concerned about the intersection where, they say, cars often speed along the road as dozens of students walk to the high school from nearby gated communities.
In this particular case, the boy had been dropped off at school and was crossing the street when he was hit. While there is a crosswalk on Via Pamplona, residents say it often does not deter motorists from speeding or pulling over in areas where they should not be dropping off students.
Residents also say having a crossing guard on Stallion Ridge is a no-brainer. More than 40 residents have already signed an online petition asking for a crossing guard there. The petition is addressed to the city, the Capistrano Unified School District’s board and the Orange County Board of Supervisors. Another student was injured last month after a hit-and-run at the same crosswalk.
If this pedestrian accident was caused by a dangerous roadway or intersection, there are a number of parties that could be held liable including the city, the school district and potentially the county. Injured victims in such cases may be able to seek compensation for damages including medical expenses, lost income, hospitalization, rehabilitative treatment/therapy, permanent injuries, disabilities and pain and suffering.
An experienced Orange County pedestrian accident lawyer will be able to advise victims regarding their legal rights and options. Please remember that any personal injury claim against a governmental entity must be filed within 180 days of the accident or injury.
