A 51-year-old Adelanto man was killed in a San Bernardino County truck accident after a big-rig that was hauling hazardous materials rear-ended the victim’s car on a Victorville roadway. According to a news report in the Victorville Daily Press, the fatal crash occurred near the intersection of Air Expressway and Phantom East the afternoon of July 30, 2012. Officials say the big rig collided with the sedan a few feet from the intersection’s crosswalk.
The truck drove into the back of the car and both vehicles came to rest in the desert field alongside the roadway. The truck was on its way to the Dr. Pepper Snapple Plant and the 1990 Cadillac Deville, according to a news report in The San Bernardino County Sun, was disabled and had its emergency lights on. The driver of the Cadillac was killed and the truck’s driver, who was a carrier for Estes Express Lines, reportedly suffered minor injuries.
I offer my deepest condolences to the family members and friends of this deceased truck accident victim. Please keep them in your thoughts and prayers.
According to California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS), there were 16 fatalities and 261 injuries as a result of Victorville car crashes in 2009. In San Bernardino County as a whole, 223 people died and 7,870 were injured due to car accidents during the same year.
What Caused This Collision?
Based on this news report, it appears that the large truck struck the disabled sedan from behind. It is not known why the truck driver failed to see the disabled Cadillac that had its emergency lights on. Was the truck driver speeding at the time? Was he distracted or inattentive? Was he fatigued or falling asleep at the wheel? I trust officials are looking into these and other issues in order to determine precisely how or why this tragic collision occurred.
Fault and Liability
If the truck driver is determined to have been at fault in this case, both he and his employer can be held liable for the victim’s wrongful death. In cases where negligence is involved, victims’ families can seek compensation for medical expenses, funeral costs, lost future income and loss of love and companionship. Victims’ families would be well advised to contact an experienced San Bernardino personal injury attorney who will stay abreast of the official investigation and ensure that their legal rights and best interests are protected.
