Two people were injured in a San Bernardino car accident after the vehicle in which they were traveling was hit by an SUV at a street intersection. According to a news report in the Victorville Daily Press, the injury car accident occurred on Highway 395 at Phelan Road the morning of January 24, 2011. Police say a silver Toyota was traveling north on the highway when a Ford SUV made a left turn into the Toyota’s path. The two vehicles collided. Two people from the Toyota were transported to a local hospital. An investigation is ongoing.
My heart goes out to the injured victims of this car accident. I hope their injuries were not catastrophic. Please keep them in your thoughts and prayers.
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 107 fatalities and 1,925 injuries involving car accidents in the unincorporated areas of San Bernardino County. Also, countywide, 263 people died and 8,504 were injured as a result of car accidents during that same time.
If the details of this news report are accurate, the female driver of the Ford SUV failed to yield right-of-way to an oncoming vehicle. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Fault and Liability
If the driver of the SUV is determined to have been at fault, she could be held liable for the injuries caused to the victims. Injured victims in such cases could seek compensation for medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. Car accident victims would also be well-advised to seek the counsel of an experienced San Bernardino personal injury lawyer, who will analyze all facets of the incident and make sure that the negligent parties are held liable.
