Two people were injured in a Ventura car accident, which officials say, was caused by two vehicles that were racing on a public roadway. According to a news report in the Ventura County Star, the injury car accident occurred the afternoon of June 19, 2011 on Camino del Sol in Oxnard. Officials say two Corvettes were racing eastbound on Camino del Sol, when one of the drivers, 28-year-old Samuel Mata, lost control and collided with two other vehicles that were traveling in the opposite direction.
An SUV rolled over and the driver had to be extricated. Two people were transported to a local hospital for treatment of non-life-threatening injuries. Mata was arrested on suspicion of street racing and driving under the influence. The driver of the other Corvette sped away from the scene. An investigation is underway.
It is indeed fortunate that none of the victims suffered life-threatening injuries in this crash. I wish them the very best for a speedy and complete recovery.
Car Accident Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 12 fatalities and 991 injuries involving car accidents in Oxnard. In Ventura County as a whole, 63 people died and 3,785 were injured due to car accidents during the same year.
Violation of Laws
If the details of this news report are accurate, it appears that Mata and another driver were racing on a public roadway, which is against California law. California Vehicle Code Section 23109 (a) states: “A person shall not engage in a motor vehicle speed contest on a highway. As used in this section, a motor vehicle speed contest includes a motor vehicle race against another vehicle, a clock, or other timing device. For purposes of this section, an event in which the time to cover a prescribed route of more than 20 miles is measured, but where the vehicle does not exceed the speed limits, is not a speed contest.” In addition, Mata was driving under the influence, which is a violation of California Vehicle Code Section 23152 (a).
Victims’ Claim for Compensation
In this case, if Mata is determined to have been at fault, not only can he be criminally prosecuted, but also held civilly liable for the injuries and damages caused. Injured victims can seek compensation for medical expenses, loss of earnings, cost of hospitalization, physical therapy and other related damages. They would be well-advised to contact an experienced Ventura personal injury lawyer, who has a successful track record of financially pursuing drunk drivers.
