My thoughts and prayers are with Sean Hendrick and the teenager injured in this pedestrian accident. I wish them both a complete and speedy recovery.
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but six injuries due to Ojai pedestrian accidents. In Ventura County as a whole, eight people died and 224 were injured as a result of pedestrian accidents in 2008.
What Caused This Accident?
Based on this news report, there are more questions than answers in this case. Where were the pedestrians walking on the street? Were they crossing the street? If they were crossing, were they in a marked crosswalk or walking across an intersection? Who had right-of-way? Was there a dangerous condition on the roadway, which may have caused or contributed to the collision? Was the driver impaired, distracted, speeding or otherwise negligent at the time of the crash? I trust officials are looking into these and other factors in order to determine who was at fault here.
If the driver is determined to have been at fault, then, she could be held liable for the victims’ injuries. Injured car accident victims could seek compensation for medical expenses, loss of earnings, cost of hospitalization, physical therapy and other related damages. A skilled Ventura personal injury lawyer will be able to advise victims in such cases about their legal rights and options.
A knowledgeable car accident lawyer will also be able to determine whether a dangerous condition on the roadway caused or contributed to this crash. If that was the case, the city or governmental entity responsible for maintaining the roadway could also be held liable. Please remember that any personal injury claim against a California public entity must be filed within 180 days of the accident or injury.
