Ventura Car Accident Proves Fatal for Motorcyclist

A 54-year-old man was fatally injured in a Ventura car accident after his motorcycle was struck by a car on Pacific Coast Highway in Oxnard. According to a news report in the Ventura County Star, the fatal motorcycle crash occurred the afternoon of April 25, 2010 on Pacific Coast Highway near Deer Creek Road. California Highway Patrol officials say that the motorcyclist, who has not yet been identified, was traveling north on PCH when the 19-year-old female driver suddenly entered the highway from the right shoulder, not noticing the approaching motorcycle.

The motorcyclist was traveling at normal speed, but didn’t have sufficient time to avoid the collision. The man was thrown off his motorcycle and landed in the middle of the road. He sustained a fractured right leg and internal injuries. He died at a nearby hospital where he was being treated.

Motorcycle Accident Statistics

There was one fatality and 15 injuries involving motorcycle accidents in Oxnard, in 2008, according to CHP’s Statewide Integrated Traffic Records System (SWITRS). In Ventura County as a whole, 11 fatalities and 227 injuries were reported as a result of motorcycle accidents during the same year.

Common Causes of Motorcycle Accidents

If the details of this news report are accurate, it appears that the driver was not paying attention to her surroundings at the time of the collision. A number of motorcycle accidents, be it at intersections or other parts of the roadway, occur because motorists are not consciously looking for motorcyclists. They look out for bigger vehicles such as cars, trucks or SUVs, but fail to consciously look out for motorcycles, bicycles or even pedestrians.

Liability Issues

If I were a member of the deceased motorcyclist’s family, I would also want to find out whether the driver was impaired, distracted, or otherwise negligent at the time of the crash. Where negligence or wrongdoing is involved, families of deceased accident victims can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future earnings, loss of love and companionship, and other related damages.

In such cases, victims’ families would be well-advised to consult with an experienced Ventura car accident lawyer who has a successful track record representing motorcycle accident victims. A skilled accident lawyer will also be able to determine whether a dangerous roadway condition may have caused or contributed to an accident. If that was the case, the governmental agency responsible for maintaining that roadway could also be held liable. Any such claim against a California governmental agency must be filed within 180 days of the accident or injury.

What steps can drivers take to consciously watch out for motorcyclists?
