Woman Critically Injured in Murrieta Car Accident

Alaina Cisneros, 26, suffered critical injuries in a Riverside car accident after she was hit by a pickup truck while crossing the road. According to a news report in The Press-Enterprise, the major injury collision occurred the evening of November 13, 2012 at the intersection of Jackson Avenue and Robards Way. Cisneros was crossing the street when the 17-year-old driver of the pickup made a left turn from northbound Jackson onto westbound Robards. Cisneros was struck and suffered major head injuries. She was transported to an area hospital where she underwent surgery. Police do not believe alcohol or drugs were involved. Officials say the streetlights in the area were working properly at the time. The investigation is ongoing.

My thoughts and prayers are with Alaina Cisneros who is fighting for her life. I wish her the very best for a speedy and complete recovery.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2010 Statewide Integrated Traffic Records System (SWITRS), one person died and seven were injured as a result of pedestrian accidents in Murrieta. In Riverside County as a whole, 32 fatalities and 349 injuries were reported due to pedestrian accidents during the same year.

Laws and Liability Issues

Based on this news account, it appears that the teen driver of the pickup truck failed to see the pedestrian at the intersection and ended up striking her. It is not clear if the young driver failed to yield the right-of-way to the pedestrian. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” In addition, drivers who are turning left are required to exercise due care and caution.

If the driver in this case is determined to have been at fault, he could be held liable for the injuries and damages caused. Injured victims in such cases can seek compensation for damages including, but not limited to, medical expenses, lost wages, cost of hospitalization, rehabilitation and other related expenses. Car accident victims and their families would be well advised to seek the counsel of an experienced Riverside personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable.
