Woman Injured in Vista Car Accident

A 44-year-old Oceanside woman was injured in a Vista car accident involving a suspected drunk driver, the afternoon of February 5, 2012. According to a news report in The U-T San Diego, the DUI crash occurred on Buena Creek Road near Monte Vista Drive. Officials say 53-year-old Teodocio Valdovinos was speeding in a 2004 Chevy Tahoe when he tried to pass a motor home by driving on the wrong side of the road. He clipped a motorcycle and struck a 2007 Toyota Sienna head on. The female driver of the Sienna suffered serious injuries and was airlifted to a nearby hospital. Valdovinos was arrested on suspicion of felony DUI causing injury.

My heart goes out to the woman who has been seriously injured in this San Diego DUI collision. Please keep her in your thoughts and prayers.

San Diego DUI Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), four people were killed and 32 were injured due to DUI collisions in the city of Vista. During that same year, 103 fatalities and 1,754 injuries occurred as a result of San Diego County DUI collisions.

Drunk Driving Laws

Based on this news report, it appears a number of vehicle codes were violated here, which led to the injury collision. The car’s driver is suspected of speeding and making an unsafe lane change at the time of the crash. He was also arrested on suspicion of driving under the influence. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

Liability Issues

In cases involving wrongdoing and negligence, the at-fault driver can be held civilly liable for the injuries suffered by the victim, in addition to facing criminal charges. Injured victims in such cases can seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. DUI accident victims would be well advised to contact an experienced San Diego personal injury lawyer, who has a successful track record of holding drunk drivers accountable.
